Real Estate Pro of the Week: Elizabeth Newlin of Mesa, Ariz.

Our featured real estate pro is Elizabeth Newlin of Mesa, ArizonaElizabeth Newlin, Realtor?, CSE, ELC, MIATM.

Quite an impressive list of designations, especially considering she?s the only real estate agent in the world who holds them.

Don?t go running for NAR?s website to look for classes, however, because I?m pretty sure they don?t offer the chance to obtain the ?Certified Sparkle Examiner,? the ?Expert-Level Cartwheeler? or even the ?Master in All Things Mothering? designations.

Or, call her the ?Certified Expert Master, for short,? Newlin jokes.

A Weekend Class Does Not an Expert Make

Those designations were self-bestowed after Newlin helped a buyer on a short sale deal. It seems the listing agent assured her that all would go well because she holds a CDPE. She then proceeded to ask Newlin to instruct her buyers to deposit their full earnest money with title, immediately, and to ?have the buyer start inspections and appraisal as soon as possible,? Newlin said on her blog.

It turns out it was the agent?s first short sale, yet she was passing herself off as a certified expert to both her client and Newlin?s. The whole ordeal prompted a frustrated Newlin to claim, ?Yes, I pretty much want to create a class and call it ?Designations are as Important In RE as a Coach Purse to My 18 Year Old Cat.??

If you?re getting the idea that Newlin has no problem speaking her mind, you?re right. To illustrate further, ask her what she?s all about.

?I?m a real estate agent, and a mom ? 47 percent of one and 53 percent of the other. I?m not telling which is which,? she begins.

?I have a compulsive need to confess my embarrassments and failures. I love Pinot Grigio and bacon equally. If someone would just make a Pinot Grigio with bacon top notes I would stand in line to buy it,? she concludes.

Writing is Boring?

Newlin began her real estate career five years ago after realizing that her writing career was boring her ?to death,? as she put it.

?I had my degree in creative writing and photography and I was a technical editor, working on technical manuals. It was horrible and boring,? she confessed.

?I was watching one of those shows about real estate agents and I thought, ?You know, I can do that. I like people and I like houses and what I?m doing now is horrible,?? Newlin said.

She ended up in real estate school, taking night classes while she was on maternity leave. ?That was during the peak when everybody was getting a real estate license,? she explained. ?I did a couple of deals really quick right after I got my license. I made these huge paychecks, so I quit my job,? she concluded.

Unfortunately, she quickly found out that practically nobody gets two huge deals within weeks of getting a license, but she bounced back and stuck with real estate.

Today, Newlin?s marketing plan is based on a Facebook and blogging model that has propelled her real estate practice to 100 percent referral-based.

Not surprising considering this woman is a people magnet.

?I write a humor blog. It?s weird because people think that a real estate blog should constantly be showing your knowledge of the market and I never do that.? Newlin explained. ?I?ll write a couple of posts about things you should know about real estate but I always do it tongue in cheek. For the most part I just write ridiculous stories.?

Ridiculous? Newlin is the mother of three sons ? 5, 8 and 12. Now, it?s been a long time since my kids were that age, but when I read her blog posts I feel like I?m right back there with the rug rats ? especially this post.

Newlin is relatable. And not just to her peers, but to any woman who has juggled a career and a family.

?They [her clients] trust me because I?m genuine, and I think people believe what I say because I have no problem saying what I think, at all times, so that makes them trust me with real estate too, which is funny, but it totally works,? she said.

The Fabulous Facebook

Some agents ?get? Facebook, and some don?t. Newlin not only gets it, she has mastered it.

?I have a huge following with a ton of people that I went to high school with who just read it because they think I?m funny and they know who I am,? she explained, and went on to joke, ?They refer people to me because they think I?m funny, and it really has very little to do with whether they think I?m any good at real estate.?

Give This Woman a Cape

When she isn?t busy being a modern-day Erma Bombeck, or shimmying down a balcony to rescue her clients who went to check out the balcony at a listing and got locked out of the house, or fleeing a vacant listing with another buyer and his kids because of strange goings-on in the garage, Newlin still finds time to spend with her three sons ? and time for herself.

?I have a million hobbies,? she said. ?I take ballet classes and I take trapeze classes. I like to hike, and I hiked the Grand Canyon this year; it?s an amazing experience, I recommend it to everyone,? Newlin said.

The one misperception about real estate agents that Newlin would banish if she could is ?the slimy stereotype,? she began, ?that idea that what we?re trying to do is talk people into buying or selling a house. That?s not what we?re all about,? she concludes.

If you haven?t figured it out yet, Newlin loves her job. ?I like the people and I like the flexibility. I like that I take my kids to school and I pick them up every day. I hated working in an office where it was the same every day. Sometimes real estate makes my head explode because it can get so crazy, but I?m never bored.? And neither are her clients.

Carrey gets serious about career, grandparenthood

LAS VEGAS (AP) ? Jim Carrey has delivered more than his share of great performances. But this undercover act wasn't one of them.

While receiving press in a Las Vegas hotel room, he was wearing large sunglasses and a sparking gold patchwork blazer.

"This is my Vegas camouflage," he joked. "If I walk around town in this (jacket) no one can see me. It's fantastic. It's the way I blend in in this town. Isn't it nice? I mugged Gustav Klimt," Carrey said, referring to the Austrian painter whose early 20th century works featured gold galore.

That's about as funny as Carrey would get on this day in Sin City promoting "The Incredible Burt Wonderstone," opening Friday. The Vegas-set comedy is about a burned-out old-school magician (Steve Carell) threatened by a newcomer (Carrey) who'll literally risk his life to wow audiences and attain fame.

"This is the guy with the Christ complex," Carrey explained. "This is the guy who looks at other people like he knows everything and they know nothing, and their problems amuse him."

It is perhaps the darkest character that Carrey has ever delivered in an out-and-out comedy.

"I could never be the type of person who thinks, 'Now this works. So, I'm just going to do this forever,'" Carrey said.

It's just the latest transformation for Carrey, who last year had a solo exhibition of his paintings and now has a children's book on the way ? something Carrey said he did in part for his grandson, born to Carrey's daughter Erin in February 2010.

"Sometimes when you go to a movie, that can be that. But when you read your kid a story, that is just a little slice of heaven," he said.

Carrey's also making music, having teamed with indie-rock band The Eels for his new single, "Cold Dead Hand," which has an anti-gun theme. "Charlton Heston would not like it," Carrey commented.

"You know, I'm always risking it and pushing it," Carrey said. "I've got nowhere to go. I have no other options. I don't have a trade."

(AP) ? For more than a billion Roman Catholics worldwide, he's Pope Francis. For Argentina's poorest citizens, crowded in "misery villages" throughout the capital, he's proudly known as one of their own, a true "slum pope."

Villa 21-24 is a slum so dangerous that most outsiders don't dare enter, but residents say Jorge Mario Bergoglio often showed up unannounced to share laughs and sips of mate, the traditional Argentine herbal tea shared by groups using a common straw.

People here recall how the Buenos Aires archbishop ditched a limousine and would arrive on a bus to their little chapel; how he sponsored marathons and carpentry classes, consoled single mothers and washed the feet of recovering drug addicts; how he became one of them.

"Four years ago, I was at my worst and I needed help. When the Mass started he knelt down and washed my feet. It hit me hard. It was such a beautiful experience," said Cristian Marcelo Reynoso, 27, a garbage collector trying to kick a cocaine addiction through the church's rehab program.

"When I saw the news on the TV, I began screaming with joy, and look, I'm still trembling," Reynoso said. "El Chabon (The Dude) is so humble. He's a fan of San Lorenzo (the soccer club), like me. You talk to him like a friend."

Long after he became a cardinal in 2001, this "prince of the church" wore a simple black T-shirt with a white collar. For many at the slum's Caacupe Virgin of the Miracles Church, it's nothing short of a miracle that their friend is the pope.

"He was always part of our slum," housewife Lidia Valdivieso, 41, said after praying while resting her palm on a statue of St. Expeditus, patron saint of urgent and impossible causes. Her 23-year-old son has cerebral palsy and is learning carpentry at the church's technical school.

"When I heard the news I couldn't believe it. Having a 'papa villero' (slum pope) is the most beautiful thing that can happen to us. I still remember him going on long walks through our muddy streets or talking to our children," Valdivieso said.

Inside the concrete block chapel, there's a painted message commemorating Bergoglio's inauguration, and another big painting of Pope John Paul II, but no sign of Benedict XVI whatsoever. Near the altar, there's a large black-and-white poster of Carlos Mugica, an iconic Argentine slum priest who was killed in 1974 by a right-wing death squad intent on eliminating the "liberation theology" he preached.

Bergoglio never favored liberation theology because of its alliances with armed leftist guerrilla movements in the 1970s. But he has done much to follow in Mugica's footsteps, sponsoring all sorts of outreach programs in Argentina's slums.

This can be messy work, obliging priests to challenge drug dealers for the slum-dwellers' allegiances, and putting their beliefs, even their lives, at risk. Sometimes compromises must be made.

Just a few steps from the chapel, melted candles stand in a red shrine to the pagan folk hero Antonio "Gauchito" Gil, a 19th century outlaw revered among Argentina's poor for sharing his stolen bounty with the poor.

Many Argentines are as likely to pray for miracles from "Gauchito" as they are from authorized Catholic saints, but Bergoglio didn't object to the shrine's presence next to his chapel.

"For more than 20 years he came here. He's always been close to us and his impact on this slum is huge," said the parish priest, Lorenzo "Toto" de Vedia.

Cameras followed Bergoglio once as he washed the feet of 12 young men at a rehab center. "Then he kept coming back, taking confession and counseling them," Vedia said. On the priest's desk lay a newspaper with a huge, one-word headline: "FRANCISCO."

"You can tell that the church is going to change," Vedia said. "The fact that he chose the name Francisco says it all. It says: *Let's stop messing around and devote ourselves to the poor. That was St. Francis* message and now 'Francisco' can live it."

In his first appearance at St. Peter's Square, the first Latin American pope bowed to the crowds and asked for their blessing. Back in Argentina, his friends in the slums recognized the gesture as the same sort of humility that won their hearts.

In the 13th century, St. Francis of Assisi made it his mission to respond to the poor and show that through simplicity and love, a stronger foundation for the church could be built.

Pope Francis' "mission is now to go on a pilgrimage to all lands, to walk with the people, to lead a church that walks," said Mercedes Trovato, 24, a youth volunteer who wore a wooden cross around her neck.

Bergoglio's friends say he's fundamentally shy. He hardly ever grants media interviews, preferring to speak from the pulpit. But he did agree to chat recently with Jaidr Flores, a 22-year-old host on the parish's Radio FM La 96.

"He was hesitant at first. But I convinced him, and at the end of the interview, he started laughing and said: "You did it! You got me on air!'" said Flores. "One day I went to visit him at his office and I was amazed to see how many pictures of the volunteers and recovered drug addicts from this community he had on his desk. He truly cares for us."

A Moroccan to compete in the Free Fight competition in Holland ...

Under the supervision of the International Mixed Martial Arts Federation, and in cooperation with Mejiro Gym Club ? Amsterdam, Holland hosts on Sunday, March 10th, 2013 an international sport competition in Free Fight. Many international champions will take part in the competition, including five Moroccans; namely, the former world?s champion in kick boxing and free fight Hassan Chkirech, Reda Bida, Ali Motawakil and Ahmed Ben Ahmed.

In a statement to Morocco World News, former world champion Hassan Chkirech explained that the objective of his participation in this international event and his fight against the former world champion Bryan Feldman is to integrate Moroccan champions in the competition and allow them to gain more experience in this sport (free fight) which is not yet recognized by the Morocco Ministry of Youth and Sports.

He went on to say that his personal participation under the name of ?Taza Federation for Creativity and Development? is not but an evidence of the absence of a Royal Moroccan Federation for Free Fight despite the existence of more than 25 Free Fight clubs scattered along the country. Recently, the League of Sous-Massa-Deraa and the League of Chaouiya for Free Fight were founded and in the near future the League of the East will follow.

In his last training session before setting out to Holland, Hassan Chkirech stated that the Federation of Taza for Creativity and Development is recognized by the International Free Fight Federation and it includes highly distinguished Moroccan champions who will mark their first participation in an international competition. The latter, Chkirech said, will probably be streamed lively on Eurosport channel.

Cybersecurity threatens US-China relations: WH official

Chinese leaders must address cybersecurity threats emanating from their country on ?an unprecedented scale? or risk weakening the economic relationship between Beijing and the United States, White House national security adviser Tom Donilon said Monday.

?U.S. businesses are speaking out about their serious concerns about sophisticated, targeted theft of confidential business information and proprietary technologies through cyberintrusions emanating from China on an unprecedented scale,? said Donilon.? ?The international community cannot afford to tolerate such activity from any country.?

The remarks, delivered to The Asia Society in New York, are the first by a White House official to specifically name China as a threat to U.S. cybersecurity.

Though Donilon focused mainly on the danger to U.S. businesses, he did acknowledge the risk such an attack could pose to U.S. national security.? He said that the issue has become ?a key point of concern and discussion with China at all levels of our governments? and that President Barack Obama has vowed to do what is necessary to protect America?s interests against cyberattacks. ?

During last month?s State of the Union address, Obama highlighted how vulnerable America?s financial institutions, power grid and air traffic control systems could be to an attack.? The president, who has signed an executive order to help address those concerns, called on Congress to pass comprehensive legislation that would better secure online networks to help protect against attacks.

The president never mentioned China during his high-profile address.

But on Monday, Donilon was much more direct, detailing three requests for Beijing, including recognition of the severity of the problem, ?serious steps? to address it and establishing guidelines of acceptable norms in the digital realm. ??

?Both countries face risks when it comes to protecting personal data and communications, financial transactions, critical infrastructure, or the intellectual property and trade secrets that are so vital to innovation and economic growth,? said Donilon.

James Lewis, a cybersecurity expert at the Center for Strategic and International Studies, said Donilon?s remarks indicate an aggressive shift in how the administration deals with China. It is a pivot, Lewis said, that comes as more and more data pours in pointing to China as the biggest culprit behind cyberattacks.

?The atmosphere has just changed; the data is overwhelming,? he said.

Lewis said protecting digital institutions is more diplomatically framed as an economic issue instead of a security one to avoid stirring threats of military action. Still it is significant the debut of the administration?s sterner policy came from the president?s top security adviser, he said. ??

A report released in February by a private security firm that found a Chinese military unit hacked more than 140 businesses, mostly inside the United States.? It?s a claim the Chinese government denies.

Media giants The New York Times and Wall Street Journal say they had been hacked for months and through an investigation with the FBI, traced the intrusions back to China.? The Wall Street Journal said the hacking was aimed at monitoring the newspaper?s China reporting, a claim that the spokesman for the Chinese foreign ministry called ?irresponsible.?

White House spokesman Jay Carney said cybersecurity will be one of the priorities the president addresses with congressional leaders when he visits Capitol Hill this week.

And the United States is not alone. European countries have suspected China has infiltrated their computer systems as well.? Nations could retaliate with sanctions against Beijing.

?It?s become a problem that China can?t ignore without harming their economy,? said Lewis.

U.N. peacekeepers freed: Syrians release 21 hostages

Syrian rebels have released 21 U.N. peacekeepers held hostage for four days. The peacekeepers crossed from?Syria?to safety in Jordan on Saturday afternoon.

Syrian rebels freed 21 U.N. peacekeepers on Saturday after holding them hostage for four days, ending a sudden entanglement with the world body that earned fighters trying to oust President Bashar Assad a flood of negative publicity.

The episode is bound to prompt new questions about U.N. operations in war-torn?Syria. The peacekeepers were part of a force that has spent four decades monitoring an Israeli-Syrian cease-fire without incident.

The Filipino peacekeepers crossed from?Syria?to safety in Jordan on Saturday afternoon, said Mokhtar Lamani, the Damascus representative of the U.N.-Arab League peace envoy to?Syria.

U.N. Secretary-General Ban Ki-moon welcomed their release, and called on all parties in?Syria?to respect the peacekeepers' freedom of movement.

The peacekeepers were seized Wednesday and were held in the village of Jamlah in southwestern?Syria, near Jordan and the Israeli-controlled Golan Heights.

Their captors from the Martyrs of the Yarmouk Brigades initially said they would only release the hostages once Syrian troops withdrew from the area. In the days leading up to the abduction, rebels had overrun several regime checkpoints and apparently feared reprisals.

However, as the abduction made headlines, the rebels eventually dropped their demand and began negotiating a safe passage for the peacekeepers with U.N. officials. On Friday, a U.N. team tried to retrieve the hostages, but aborted the plan because of heavy regime shelling of the area.

On Saturday, another U.N. team headed toward Jamlah to try again, said a rebel spokesman, who spoke via Skype, insisting on anonymity for fear of reprisals.

He said the U.N. team aborted the mission because of fighting in the area, and that the rebels instead escorted the hostages to the Syrian-Jordanian border.

Lamani said the U.N. team was near Jamlah and was waiting for the rebels to hand over the hostages when the rebels changed their minds and instead drove the peacekeepers to the Jordanian border.

"They asked us to wait for an hour as they negotiated between themselves. Then we were surprised to hear to hear the news from a satellite channel that they had reached Jordan," he said. "Praise God in the end that all of them were released safely."

For its part, the Syrian Foreign Ministry said in a letter to the United Nations that was shared with the media that the Syrian army had held its fire in the area "out of concern for the security and safety of the UN forces."

Report details flaws in Army's handling of PTSD

(AP) ? An Army report released Friday finds the service still has trouble diagnosing and treating soldiers for post-traumatic stress disorder, despite more than doubling its number of military and civilian behavioral health workers over the past five years.

Confusing paperwork, inconsistent training and guidelines, and incompatible data systems have hindered the service as it tries to deal with behavioral health issues, the report said. It's a crucial issue: After a decade of war, soldier suicides outpace combat deaths.

Last May, the Army commissioned a task force to conduct a sweeping review of how it evaluates soldiers for mental health problems at all its facilities. The review came under pressure from Democratic Sen. Patty Murray, of Washington, who was upset to learn that hundreds of soldiers at Madigan Army Medical Center south of Seattle had had their PTSD diagnoses reversed by a forensic psychiatry team, resulting in a potential cut to their benefits and questions about whether the changes were made to save money.

About 150 of those soldiers eventually had their diagnoses restored.

"I am pleased that the Army completed this review and has vowed to make fixes over the next year, though I am disappointed it has taken more than a decade of war to get to this point," Murray said in a statement. "Many of the 24 findings and 47 recommendations in this report are not new. Creating a universal electronic health record, providing better rural health access, and standardizing the way diagnoses are made, for instance, have been lingering problems for far too long. Our service members and their families deserve better."

The report noted that the Army had made strides in some areas, including cutting how long it takes soldiers to obtain a disability evaluation and publishing a guide to the process.

On a conference call with reporters, Army brass emphasized that many of the report's recommendations are already being put into effect. For example, over the past year the Army has been assigning behavioral health workers to brigade combat teams so soldiers will feel more familiar with them and more comfortable about getting help, said Lt. Gen. Patricia D. Horoho, who heads the Army's Medical Command.

Horoho also stressed that there was no evidence that malice motivated the altered diagnoses at Madigan; rather, the changes amounted to difference of opinion, she said.

The task force interviewed 750 people stationed around the globe, conducted listening sessions with 6,400 others and reviewed more than 140,000 records. The Medical Command reviewed diagnoses for all soldiers evaluated for behavioral health problems from October 2001 until last April.

Since September 2001, the report found, 4.1 percent of all soldiers deployed wound up in the disability system with a behavioral health diagnosis such as PTSD or traumatic brain injury.

Nationwide, the report said, 6,400 soldiers had behavioral health diagnoses "adjusted" by medical evaluation boards, with approximately equal numbers having PTSD added as a diagnosis and removed as a diagnosis.

Two locations where medical evaluation boards are held had slightly higher rates of diagnosis changes than the Army-wide average ? Fort Polk in Louisiana and Fort Irwin in California, Horoho said. Cases from those locations are being reviewed to ensure no soldiers were improperly affected, but part of the reason for the higher rates may be because those bases rely heavily on civilian health workers, she said.

Last year the Army ? and the military as a whole ? suffered the highest number of suicides ever recorded, prompting then-Defense Secretary Leon Panetta to declare it an epidemic. The Army had 183 suicides among active-duty soldiers, up from 167 in 2011, and the military as a whole had 350 suicides, up from 301 the year before.

Among the problems the report documented was that Army bases don't have a person on site dedicated to overseeing behavioral health issues, despite the many problems they can cause: suicide, alcohol abuse, drug abuse, and child and spouse abuse. Each installation needs someone with a view of all those programs to make recommendations to the commander, the report said.

Army Secretary John M. McHugh said in a statement that the Army will work to place behavioral health experts "at the command and installation levels to provide better consultation, guidance, coordination and recommendations to improve behavioral health care for our soldiers."

The task force found that of the soldiers surveyed, 37 percent had never received any information about the Army's disability evaluation system or had to seek the information out on their own. It also said it was confusing and inefficient for troops to navigate the vastly different disability systems maintained by the Army and the Veterans Administration.

The Army and VA plan to have a joint disability system, by which health care providers in either organization will have access to records, by 2017.

"Some changes can be made immediately," McHugh said. "Others will require more time and coordination. Importantly, this report reviewed our systems holistically ? recommending not only short-term solutions, but longer term, systemic changes that will make care and treatment of our soldiers and family members more effective."

Players' association gives OK to NHL realignment

(AP) ? The NHL moved a step closer to realignment Thursday as the players' association approved a proposed plan that is set to go into effect next season.

Now that the league has gotten the go-ahead from union chief Donald Fehr, the NHL will only need to get approval from team owners to put it in place.

"The NHL Players' Association confirmed to us today that it has consented to a revised plan for realignment, effective for the 2013-14 season," NHL Deputy Commissioner Bill Daly said in a statement. "Our next step will be to bring the proposed plan for realignment to the NHL board of governors for its consideration."

Fehr signed off on the plan after discussions with the union's executive board and said the realignment issue will be "re-evaluated following the 2014-15 season."

No official details of the changes have been released by the NHL, but it is widely believed that teams such as Detroit and Columbus will be put into more travel-friendly divisions in the Eastern time zone, and the Winnipeg Jets ? formerly the Atlanta Thrashers ? will leave the Southeast Division for a spot in the Western Conference.

Up until now, there has been an even split of teams with 15 in each conference. Under the new plan, the East will have 16 clubs in it ? making playoff qualification a bit tougher.

The two divisions out West will contain seven teams each. The East divisions will both contain eight.

Each conference will still have eight teams in the playoffs but the setup will be slightly different.

Instead of the current system, under which the top eight teams in each conference make the playoffs, the new plan will award spots to the top three teams in each division along with the next two teams with the best records as wild cards.

The new Atlantic Division in the East will be comprised of Carolina, Columbus, New Jersey, New York's Rangers and Islanders, Philadelphia, Pittsburgh and Washington. The Central Division will contain Boston, Buffalo, Detroit, Florida, Montreal, Ottawa, Tampa Bay and Toronto.

Out West, the new Midwest Division will feature Chicago, Colorado, Dallas, Minnesota, Nashville, St. Louis and Winnipeg. The Pacific Division will be made up of Anaheim, Calgary, Edmonton, Los Angeles, Phoenix, San Jose and Vancouver.

Dear Mom Judging Me For My iPhone

A couple of weeks ago, Jeff and I spent a morning running around after our children during a carnival hosted at their school. As hour number three approached, my capacity for other people?s children rapidly reaching code red zone, I pulled out my phone and hopped on Twitter for a few minutes. Of course, those few minutes happened to coincide with my bumping into one of my children?s teachers.

?

After she greeted me, she gently pulled the phone out of my hand and whispered ?tsk, tsk? as she shook her head. My face turned red as she gestured to the surrounding children whom I clearly should have been watching instead. My phone shamefully remained in my coat pocket for the rest of the afternoon, while I found other ways to occupy the time, none of which included actually playing with the kids who blissfully ignored my presence while they ran around with their friends.

I forgot about the whole interaction (or, rather blocked it out) until I came across a post yesterday,?Dear Mom on The iPhone.?It begins?

Dear Mom On the iPhone,

I see you over there on the bench, messing on your iPhone.
It feels good to relax a little while your kids have fun in the sunshine, doesn?t it?
You are doing a great job with your kids, you work hard,
you teach them manners, have them do their chores.

But Momma, let me tell you what you?don?t?see right now?..

Your little girl is spinning round and round, making her dress twirl.
She is such a little beauty queen already, the sun shining behind her long hair.
She keeps glancing your way to see if you are watching her.?

It?goes on and on and on about the precious moments that a mother is missing while immersed in technology. ?Now you are pushing your baby in the swing. She loves it! Cooing and smiling with every push. You don?t see her though, do you? Your head is bent, your eyes on your phone as you absently push her swing.?

?

Bad, bad mother, the comments preach. How selfish! How self-absorbed! How dare a mother?absentmindedly push a swing when she could be relishing every single back and forth motion. What is our society coming to?

?

Well, I am that mother at the park on her iPhone, thank you very much. I?m the one who gets scowled at and pointed to and written about. Sometimes it?s the park, others it?s an indoor playzone or maybe it?s a birthday party. If I?m out with my kids, and they are entertained, it?s not uncommon that my iPhone is entertaining me. But that fact doesn?t?make me a bad mom. In fact, I?d argue that it helps make me a better one.

?

Checking in on Twitter or?Facebook?allows me to collect myself and maintain a sense of humor about things that might otherwise set me off. It?s kind of the social media immersed mother?s version of a long drag on a cigarette. It helps ground me and gain perspective.?The permanent marker covered Evan a few years ago would have been far more upsetting than amusing were it not for the ensuing hilarity in?Facebook?comments. Having my friends and community a simple click away is a much needed break at the very least, and a near lifesaver at the most.

?

I work from home,?and part of working from home (FYI,?Marissa Mayer) means taking that work with me, wherever my day may go. I am fortunate to have the freedom and flexibility to bring my kids into school every day and pick them up at three and spend the afternoon and evening hours with them. And I treasure that ability. If it means having to respond to e-mails or follow up on things while the rest of the working world is still behind a desk, I don?t see that as a problem. Would it be better to get a traditional desk job and have a nanny caring for them all day and night?

?

Besides, being on my phone in public, at places like sports practice where the kids are surrounded by friends and the park where they can run around and play, makes it more likely that I?ll be off of the phone when I?m home alone with them.

?

And maybe, I?m on my phone at the park because I don?t really feel like engaging with that preachy looking mother who, if not judging me for my phone use, would most certainly find something else about me to be appalled by.

?

I would never, ever claim to be a perfect mother. I have moments of stellar mothering and moments of complete crappiness, and they are usually separated by mere seconds.?At the end of the day, I strive for two things: 1. To make my children feel loved, and 2. To have the proud parenting moments outweigh the regrettable ones. Adding ?always place undivided attention on my children 24/7? to the list really wouldn?t benefit my children and it sure as hell wouldn?t benefit me.

?

One small snippet that someone happens to witness at a park or a?restaurant or in a parking lot hardly paints a thorough picture of?any?family, so judging based on what you happen to catch in a single moment is laughable. Almost as laughable as the notion of taking my kids to a bounce zone and having my eyes glued to them jumping up and down for four hours straight.

Astronomers find 'lost' supernova

Mar. 7, 2013 ? The star Eta Carinae is ready to blow. 170 years ago, this 100-solar-mass object belched out several suns' worth of gas in an eruption that made it the second-brightest star after Sirius. That was just a precursor to the main event, since it will eventually go supernova.

Supernova explosions of massive stars are common in spiral galaxies like the Milky Way, where new stars are forming all the time. They are almost never seen in elliptical galaxies where star formation has nearly ceased. As a result, astronomers were surprised to find a young-looking supernova in an old galaxy. Supernova PS1-12sk, discovered with the Pan-STARRS telescope on Haleakala, is rare in more ways than one.

"This supernova is one-of-a-kind," said Nathan Sanders of the Harvard-Smithsonian Center for Astrophysics (CfA), lead author of the discovery paper. "And it's definitely in the wrong neighborhood."

Based on the presence of helium and other features, PS1-12sk is classified as a very rare Type Ibn supernova -- only the sixth such example found out of thousands of supernovae. Although the origin of this supernova type is unclear, the most likely cause seems to be the explosion of a massive star that previously ejected massive amounts of helium gas, much like Eta Carinae's Homunculus Nebula.

That origin was supported by the fact that the five previous Type Ibn supernovae were all found in galaxies like the Milky Way that are actively forming stars. (Since massive stars don't live long, they don't stray far from where they are born before exploding.)

PS1-12sk is different. It was found on the outskirts of a bright elliptical galaxy located about 780 million light-years from Earth. The site of the explosion shows no signs of recent star formation, and a supernova from a massive star has never before been seen in a galaxy of this type.

"It could be that we simply got very lucky with this discovery. But luck favors the prepared," said second author Alicia Soderberg of the CfA.

The finding suggests that the host galaxy might be hiding a star factory, allowing it to form massive stars where none were expected. Alternatively, PS1-12sk might have an entirely different origin such as a collision of two white dwarfs, one of which was helium-rich.

"Is this a runaway star from another star formation site? Is it a very local bit of star formation? Is it a different way for such a supernova to occur? None of these seems very likely so we have a real puzzle," said co-author John Tonry (University of Hawaii Institute for Astronomy).

The research has been submitted for publication in The Astrophysical Journal.

HIMSS: Mobile devices raise thorny legal issues in healthcare

Organizations will need to develop a mobile devices policy that applies to their particular circumstances, however, as there isn't a one-size-fits-all policy that works for everyone, said Brian Balow, an attorney with law firm Dickinson Wright.

"Enterprises and entities might think it's OK to reach out to the Web, find a sample policy, and put it in the drawer and say we're compliant," he said. "I can tell you right now it's not going to work. If you get audited or something comes up, it's not going to work for you."

Balow discussed the legal issues associated with the use of mobile devices during a HIMSS Knowledge Center session.

In terms of security challenges, mobile devices are more likely to be lost compared to other devices, he said. In addition, the practice of "bring your own device" (BYOD) -- in which staff members use their own mobile devices to connect to the corporate network -- increases risk, as these devices may be shared with others. Users may not be technically sophisticated and may be more likely to pick up a virus.

If multiple devices are used, that's a lot for IT teams to manage, as security measures must be employed to protect the various platforms, Balow said. He noted that institutions must also consider the ways employees use devices and the kinds of issues that could arise, such as the use of social media, random websites, and even the texting of patient protected health information (PHI).

"I don't know why they would do it, but healthcare personnel have used their mobile devices to text PHI about patients," he said. "And related to that, there have been numerous cases where healthcare personnel have used their iPads or other tablet devices to access social media sites like Facebook to post protected health information, including photos of patients."

Institutions should also keep an eye out for employee use of jailbroken devices that allow them to get around security safeguards for those particular devices, he said.

Healthcare organizations need to be concerned about the use of mobile devices due to compliance concerns for PHI and to comply with internal controls for protecting confidential business information about your own company.

Laws that may apply to mobile devices include breach notification laws, data destruction laws, litigation holds over the location of data, and wage and hour laws that lead to paying overtime for use of devices for business purposes after hours, he said. Malpractice issues may also come into play.

Increased scrutiny

Legislators are raising concerns about the use of mobile devices in healthcare regarding the safety, security, and reliability of the network infrastructure, he said. In addition, a number of agencies are evaluating this issue, including the U.S. Food and Drug Administration (FDA), the Federal Communications Commission (FCC), the U.S. Department of Commerce's National Institute of Standards and Technology (NIST), the Federal Trade Commission (FTC), and the U.S. Department of Health and Human Services' Office for Civil Rights (OCR).

Regulatory activity regarding mobile devices is also picking up on the state level, particularly in California. In February 2012, California launched the Mobile App Privacy Program, which has signed on companies such as Amazon, Apple, Google, Hewlett-Packard, Microsoft, Research in Motion, and Facebook, Balow said. A Privacy Enforcement and Protection Unit was created in July.

U.S. enforcement bodies include the OCR, which monitors HIPAA violations. The FTC focuses on protecting consumers, so no industry is off-limits, according to Balow. State attorneys general also enforce HIPAA penalties.

With the HIPAA final rule released in January, covered entities, business associates, and subcontractors must adopt appropriate data security safeguards for PHI, he said.

"There are no more excuses," he said.

Unauthorized PHI disclosures or other failures to comply with HIPAA Privacy and Security rules may result in civil penalties and potential criminal liability.

BYOD?

Healthcare institutions should draft a BYOD policy to protect their patients' rights, to instill professionalism throughout the enterprise, and to protect both the organization and employees from liability, according to Balow.

Before developing such a policy, organizations should understand their IT enterprise and weigh the economic pros and cons of BYOD to the enterprise, he said. They should also perform a formal risk assessment to understand the risks to the enterprise from BYOD.

"Then determine, based on these considerations, whether to adopt BYOD," he said.

Stakeholders who should be involved in this process include senior management, the chief medical information officer/chief privacy officer, the chief IT officer, IT staff, and the legal/regulatory and human resources departments, Balow said.

Many separate policies affect the use of BYOD, including acceptable use policies, security policies, social media policy, remote access policy, remote working policy, incident response policy, breach notification policy, privacy policies, and a litigation hold policy, he said.

A discrete BYOD policy should cover issues such as those in this document from the SANS Institute, he said. It should also incorporate other related policies such as privacy, acceptable use, and social media by referring to them.

In addition to stating why the policy was created, it should delineate its scope, including supported devices, the state of supported devices (such as if they are jailbroken), reimbursement of costs, approved applications, and other limitations such as the use of cameras.

The policy should also spell out who it covers, Balow said. Roles and responsibilities for implementation should be included, and the policy needs to be enforced.

"This policy should have been created yesterday if you are already allowing BYOD, and today if you have decided to allow BYOD," he said.

Balow also suggested some other resources on this topic, including a federal government BYOD toolkit and a HIMSS white paper on the consumerization of mobile devices.

Microsoft fined $733 million for breaking browser pact

AMSTERDAM? -- The European Union has fined Microsoft (euro) 561 million ($733 million) for breaking a pledge to offer personal computer users a choice of Internet browsers when they install the company's flagship Windows operating system.

The penalty imposed by the EU's executive arm, the Commission, is a first for Brussels: no company has ever failed to keep its end of a bargain with EU authorities before.

In 2009, Microsoft Corp. struck a broad settlement with the Commission to resolve disputes over Microsoft's abuse of the dominance of Windows, which had spanned more than a decade.

The company agreed to pay (euro) 860 million and promised to give Windows users the option of choosing another browser rather than having Microsoft's Internet Explorer automatically installed on their machines.

But Microsoft failed to stick to the deal for some 15 million installations of Windows 7 in Europe from May 2011 until July 2012. The company admitted the failure last year, adding that it was an oversight.

The Commission's top regulator, Joaquin Almunia, said at a press conference in Brussels, Belgium, Wednesday that the fine reflected the size of the violation and the length of time it went on. It was also intended to make an example of Microsoft and deter other companies from doing same thing.

"A failure to comply is a very serious infringement that must be sanctioned accordingly," he said.

Almunia has advocated negotiated settlements since he took office in 2010, saying competition issues are best resolved quickly. He says slapping big fines on companies years after the fact does little to help consumers.

But he said the whole point of a settlement is undermined when companies then don't abide by its terms.

"They must do what they committed to do, or face the consequences," he said.

Almunia conceded that the Commission had been "naive" in appointing Microsoft itself to oversee compliance with the agreement, and said the Commission won't allow that in the future.

For its part, Microsoft was apologetic.

"We take full responsibility for the technical error that caused this problem and have apologized for it," the company said in a statement. "We provided the Commission with a complete and candid assessment of the situation, and we have taken steps ... to help avoid this mistake -- or anything similar -- in the future.?

The company is required to offer consumers a choice of browsers through 2014.

In all, Microsoft has now paid a grand total of (euro) 2.2 billion in fines to the Commission since 1998, when regulators opened their first investigation against the company. Some of those fines were for failing to obey the commission's orders, but this is the first time a company has admitted to breaking a promise made to the EU regulator.

The competitive landscape has changed greatly in recent years, however. Tech companies are now often more concerned about Google Inc.'s dominance in Internet search technology, Facebook's dominance in social networking, and Apple's dominance in mobile phones and software than Microsoft's Windows operating system, though it is still dominant on personal desktop computers.

Rival browsers such as Mozilla's Firefox and Google's Chrome have become popular, and software applications on mobile devices usually bypass browsers entirely.

In a sign of the times, Microsoft itself turned to the watchdog in 2012, asking it to investigate Google for anticompetitive practices.

Alistair Overeem injured, withdraws from UFC 160 fight with Junior dos Santos; Mark Hunt volunteers replacement

Alistair Overeem, coming off a tough knockout loss to Antonio Silva at UFC 156, was scheduled to face his rival and former UFC heavyweight champion Junior dos Santos at UFC 160 this May. Unfortunately, he has succumbed to injury and will be unable to take the fight. Mark Hunt, fresh off a knockout victory over Stefan Struve at UFC on Fuel TV 8, has expressed interest in a potential match up with dos Santos at the event.

Perhaps it's a Heavyweight mixed martial arts (MMA) match up that is just not meant to ever happen.

After their initial showdown blew up at UFC 146 thanks to a positive test for abnormally high levels of testosterone (more on that here), it appeared that the grudge match between then-champion Junior dos Santos and former K-1, Strikeforce champion and then-No. 1 division contender, Alistair Overeem, was all but certain when it was recently re-booked as the upcoming UFC 160 co-main event.

Think again.

MMAFighting.com confirmed today (March 6, 2013) that "The Reem" has once again been forced to bow out; however, this time around he can blame it on an injury sustained in training and not performance-enhancing substances. He was looking to rebound after a stunning knockout loss to Antonio Silva at UFC 156 (watch it here), while dos Santos was also looking to get back on the horse after surviving a 25-minute beatdown at the capable hands of Cain Velasquez (watch it here).

Both fighters, naturally, are more than likely still eager to get back in the win column in their next Octagon appearances. However, it just won't come at each others' expense.

Meanwhile, with the pay-per-view (PPV) event, which takes place at MGM Grand Garden Arena in Las Vegas, Nevada, on May 25, 2013, little more than two months away, Ultimate Fighting Championship (UFC) will have to line up a quick replacement fight for "Cigano" to keep him on the stacked Memorial Day weekend card.

The good news is that the timing could not be better for one of the recent winners at UFC on FUEL TV 8, Mark Hunt.

"The Super Samoan" told the media that he wanted a quick turnaround after his jaw-breaking knockout (see the damage here and video here) win over Stefan Struve, preferably with a Top 5 opponent (his words here). When contacted by MMAFighting.com, here's what he had to say on the matter:

"If I get the call for the fight, I'm there, of course ... and the fans are crazy for it, so it's good."

This would certainly be an interesting fight, and it couldn't have been timed better for the resurrection of Hunt, who has won four straight fights inside the Octagon, dating back to Feb. 2011.
